OVERVIEW
This website is operated by SAINCH. Throughout the site, the terms “SAINCH,” “we,” “us,” and “our” refer to SAINCH. We provide this website, including its information, features, tools, products, and related services (collectively, the “Services”), to you subject to these Terms of Service (“Terms”). Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and Services.
Please read these Terms carefully before using our website or placing an order. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
These Terms do not exclude or limit any rights that cannot lawfully be excluded or limited under applicable consumer protection laws.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
You must be at least the age of majority in your place of residence to make a purchase through the Services. If you create an account, you are responsible for keeping your login information secure and for activity conducted through your account.
You agree to provide accurate, current, and complete account, billing, payment, contact, and delivery information. Please update this information when necessary so we can process your order and contact you about it.
SECTION 2 — PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to present product descriptions, dimensions, materials, finishes, colors, and images accurately. Because displays, lighting conditions, photography, production batches, and natural materials vary, the item you receive may show reasonable differences in color, grain, texture, pattern, or finish.
Furniture dimensions are approximate and minor production tolerances may occur. Before ordering, you are responsible for reviewing the product dimensions and confirming that the item and its packaging can pass through the intended delivery route, including doors, hallways, stairways, elevators, and building entrances.
Product information, availability, specifications, and prices may be corrected or updated when reasonably necessary. We may discontinue a product or limit quantities available for purchase. Any change affecting an accepted order will be communicated to you where required.
SECTION 3 — ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase. Receipt of an automated order confirmation does not necessarily mean that the order has been accepted. An order is accepted when we confirm it for processing or dispatch it, subject to applicable law.
We may decline or cancel an order for legitimate reasons, including product unavailability, suspected fraud, payment authorization failure, an obvious pricing or listing error, delivery restrictions, or an incorrect or incomplete address. If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled item or order.
Please review your order carefully before submitting it. If you need to cancel or change an order, contact support@sainch.com as soon as possible. We cannot guarantee changes or cancellation after processing or shipment has begun. Shipped orders are handled under our Return & Refund Policy.
Unless we agree otherwise in writing, products purchased through our consumer store are intended for personal or household use and not for unauthorized resale.
SECTION 4 — PRICES, TAXES, AND PAYMENT
Prices, discounts, and promotions may change without notice. The price applicable to your purchase is the price shown at checkout when the order is submitted, except in the case of an obvious error.
Applicable shipping charges and taxes will be displayed at checkout where they can be calculated. International orders may be subject to customs duties, import taxes, brokerage fees, or other charges as described in our Shipping Policy.
You confirm that you are authorized to use the payment method submitted and that the payment information is accurate. We or our payment providers may perform authorization, fraud-prevention, and verification checks before accepting an order.
Promotions may have separate conditions. If promotional terms conflict with these Terms regarding that promotion, the promotional terms will apply.
SECTION 5 — SHIPPING AND DELIVERY
We ship from multiple warehouse locations and, when possible, arrange fulfillment from a location near the delivery address. Shipping availability, costs, processing times, estimated delivery windows, and delivery conditions are described in our Shipping Policy.
Most service areas qualify for free shipping, while additional charges may apply to certain remote or non-standard delivery areas. Any applicable charge will be shown at checkout before payment.
Delivery dates are estimates and may be affected by carrier operations, weather, customs, holidays, address issues, or other circumstances outside our reasonable control. Nothing in this section limits any delivery rights or remedies available under applicable law.
Large furniture may be delivered to the first safe and accessible location at the address. In-home placement, unpacking, packaging removal, and assembly are not included unless expressly stated on the product page or confirmed in writing.
SECTION 6 — RETURNS, REFUNDS, AND CANCELLATIONS
Returns, refunds, exchanges, and order cancellations are governed by our Return & Refund Policy. Eligible returns must be requested within the applicable return period and authorized before shipment back to us.
Do not return an item to the address on its original shipping label. The correct return instructions and address will be provided after a return request is reviewed and approved.
SECTION 7 — LIMITED WARRANTY
Eligible SAINCH furniture is covered by our One-Year Limited Warranty against verified manufacturing defects in materials and workmanship under normal residential use. Coverage, exclusions, documentation requirements, and available remedies are described in our Warranty Policy.
Natural variations in wood, leather, fabric, color, grain, and texture, as well as normal wear and tear, are not manufacturing defects. Our written warranty is in addition to any mandatory rights available under applicable consumer law.
SECTION 8 — WEBSITE USE AND PROHIBITED CONDUCT
You may use the Services only for lawful, personal, and non-commercial purposes. You must not:
• Violate any applicable law or the rights of another person;
• Use the Services for fraud, deception, harassment, abuse, or unlawful activity;
• Upload or transmit viruses, malware, or other harmful code;
• Interfere with the operation, security, or availability of the Services;
• Attempt unauthorized access to an account, system, or network;
• Scrape, crawl, copy, reproduce, resell, or exploit the Services or their content without authorization;
• Collect personal information about others without lawful authority;
• Impersonate another person or misrepresent your identity; or
• Use the Services to send spam or unauthorized advertising.
We may restrict or suspend access when reasonably necessary to protect the Services, our customers, or our legal rights.
SECTION 9 — INTELLECTUAL PROPERTY
The Services and their content—including text, product information, photographs, graphics, videos, logos, page designs, and other materials—are owned by or licensed to SAINCH and are protected by applicable intellectual property laws.
You may access the Services for personal, non-commercial use. Except as permitted by law or with our prior written consent, you may not reproduce, distribute, modify, publish, display, sell, license, or create derivative works from our content.
SAINCH names, logos, and brand elements may not be used without permission. Third-party names and marks remain the property of their respective owners.
SECTION 10 — THIRD-PARTY SERVICES AND LINKS
The Services may include links to or features provided by third parties, such as payment providers, carriers, analytics services, or social platforms. Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party websites or services that we do not control, except where applicable law provides otherwise.
Please review a third party’s terms and policies before using its services or completing a transaction with it.
SECTION 11 — SHOPIFY
Our store is hosted by Shopify. Purchases made from SAINCH are transactions directly between you and SAINCH; Shopify is the platform provider and is not the seller of our products. Your use of Shopify-supported features may also be subject to Shopify’s applicable terms and privacy practices.
SECTION 12 — PRIVACY
Our collection and use of personal information are described in our Privacy Policy. Because our store and related functions are supported by Shopify and other service providers, information may be processed by those providers as necessary to operate the Services, complete transactions, prevent fraud, arrange delivery, and provide customer support.
SECTION 13 — REVIEWS, PHOTOS, AND FEEDBACK
If you voluntarily submit a review, photograph, video, suggestion, or other feedback (“Feedback”), you confirm that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights.
You grant SAINCH a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that Feedback for operating, improving, and promoting the Services, subject to applicable law and our Privacy Policy. This permission does not transfer your ownership of the Feedback.
We may moderate or remove Feedback that is unlawful, misleading, abusive, infringing, or unrelated to the product or Services. Any incentive connected with a review must be disclosed.
SECTION 14 — ERRORS AND CORRECTIONS
Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to descriptions, prices, promotions, shipping charges, delivery estimates, or availability. We may correct such information and update the Services.
If an error materially affects an order you have already placed, we will contact you when reasonably possible and provide the options required by applicable law, which may include confirming the corrected terms or cancelling the affected item for a refund.
SECTION 15 — DISCLAIMERS
We aim to keep the Services accurate and available, but website access may occasionally be interrupted or contain errors. To the fullest extent permitted by law, the website and its general informational content are provided on an “as available” basis.
Products are covered only by the warranties expressly stated in our Warranty Policy and any warranties or consumer rights that cannot legally be excluded. We do not exclude or limit liability where doing so would be unlawful.
SECTION 16 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, SAINCH and its affiliates, officers, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services or products, including loss of profits, revenue, data, or business opportunity.
Where liability may lawfully be limited, our aggregate liability relating to an order will not exceed the amount paid for the product giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence where it cannot lawfully be limited, death or personal injury caused by negligence, or any other liability or consumer remedy that cannot be excluded under applicable law.
SECTION 17 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify SAINCH and its affiliates, officers, employees, and service providers against third-party claims, losses, or reasonable costs arising directly from your unlawful use of the Services, your material breach of these Terms, or your violation of another person’s rights.
SECTION 18 — TERMINATION
You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, misuse the Services, threaten their security, or engage in unlawful conduct.
Termination does not affect rights or obligations that arose before termination. Provisions that by their nature should continue—including intellectual property, disclaimers, liability limitations, and governing law—will survive.
SECTION 19 — SEVERABILITY AND WAIVER
If any provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted or severed where necessary. The remaining provisions will continue in effect.
Our failure to enforce a provision on one occasion is not a waiver of that provision or our right to enforce it later.
SECTION 20 — ENTIRE AGREEMENT
These Terms, together with the policies expressly referenced in them, form the agreement between you and SAINCH concerning the Services and supersede prior versions or communications concerning the same subject matter.
If a translated version of these Terms is provided and there is a conflict, the English version will control to the extent permitted by applicable law.
SECTION 21 — ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, sale of assets, or transfer of the business, subject to applicable law and without reducing your existing consumer rights.
SECTION 22 — GOVERNING LAW
These Terms are governed by the laws applicable to SAINCH’s operating entity, without depriving you of any mandatory protections available under the laws of your usual place of residence. Any dispute will be handled by a court or forum having lawful jurisdiction.
SECTION 23 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our Services, policies, or legal obligations. The current version and its effective date will be posted on this page. Where required by law, we will provide additional notice of material changes.
Changes will apply prospectively from their stated effective date. Your continued use of the Services after that date constitutes acceptance to the extent permitted by law.
